নিয়ম ও শর্তাবলী

১) পরিচিতি:

Sweezy-এ স্বাগতম, এটি “আমরা”, “আমাদের”, “ফিলবার্ট লিমিটেড” বা “Sweezy” নামেও পরিচিত। “Sweezy” হল ফিলবার্ট লিমিটেডের একটি ট্রেডমার্ক ব্র্যান্ড। আমরা একটি অনলাইন মার্কেটপ্লেস, এবং এইগুলি হল আপনার অ্যাক্সেস এবং Sweezy এর সাথে সম্পর্কিত সাব-ডোমেন, সাইট, মোবাইল অ্যাপ, পরিষেবা এবং টুলস (“Sweezy”) এর ব্যবহার নিয়ন্ত্রণকারী শর্তাবলী। সাইট ব্যবহার করে, আপনি এতদ্বারা এই শর্তাবলী স্বীকার করেন এবং প্রতিনিধিত্ব করেন যে আপনি এই শর্তাবলী (“ব্যবহারকারীর চুক্তি”) মেনে চলতে সম্মত হন। এই ইউজার এগ্রিমেন্ট আপনার সাইটের ব্যবহারের উপর কার্যকর বলে গণ্য করা হয় যা এই শর্তাবলীর আপনার সম্মতি নির্দেশ করে। আপনি যদি এই ব্যবহারকারী চুক্তির দ্বারা আবদ্ধ হতে সম্মত না হন তবে অনুগ্রহ করে এই সাইটে প্রবেশ, নিবন্ধন বা ব্যবহার করবেন না। এই সাইটটি Sweezy এবং ফিলবার্ট লিমিটেডের মালিকানাধীন এবং পরিচালিত।

২. ব্যবহারের শর্তাবলী:

ক. নিষেধাজ্ঞা:

এই ওয়েবসাইটটি ভুলভাবে ব্যবহার করা যাবে না। আপনি বেআইনি কার্যকলাপে জড়িত হবেন না বা অন্যদের তা করতে প্ররোচিত করবেন না; আপনি অযাচিত বিজ্ঞাপন বা প্রচারমূলক সামগ্রী পাঠাবেন না, যা “স্প্যাম” নামেও পরিচিত; আপনি পরিষেবার কোনো দিক হ্যাক করবেন না; আপনি ডেটা নষ্ট করবেন না; আপনি অন্য ব্যবহারকারীদের বিরক্ত করার কারণ হবে না; এবং আপনি অন্য কোনো উপাদান প্রেরণ বা বিতরণ করবেন না যা দূষিত, প্রযুক্তিগতভাবে ক্ষতিকারক, আস্থার লঙ্ঘন বা অন্য কোনো উপায়ে আপত্তিকর বা অশ্লীল। এই ধারার লঙ্ঘন বেআইনি হবে, এবং ফিলবার্ট লিমিটেড উপযুক্ত আইন প্রয়োগকারী সংস্থাগুলিকে এই ধরনের লঙ্ঘনের বিষয়ে অবহিত করবে এবং তাদের কাছে আপনার তথ্য সরবরাহ করবে।

আপনার এই ওয়েবসাইটটি ব্যবহার করার ফলে বা এটিতে বা এটির সাথে লিঙ্কযুক্ত যেকোন ওয়েবসাইটে পোস্ট করা কোনও সামগ্রী ডাউনলোড করার ফলে, বিতরণ করা ডিনায়াল-অফ-সার্ভিস আক্রমণ, ভাইরাস দ্বারা সৃষ্ট কোনও ক্ষতি বা ক্ষতির জন্য আমরা দায়ী থাকব না। বা অন্যান্য প্রযুক্তিগতভাবে ক্ষতিকারক উপাদান যা আপনার কম্পিউটার সরঞ্জাম, কম্পিউটার প্রোগ্রাম, ডেটা, বা অন্যান্য মালিকানাধীন উপাদানগুলিকে সংক্রামিত করতে পারে৷

খ. আপনার অ্যাকাউন্ট:

প্ল্যাটফর্মের দ্বারা প্রদত্ত কিছু পরিষেবা অ্যাক্সেস করার জন্য, আমাদের প্রয়োজন হতে পারে যে আপনি আমাদের সাথে একটি অ্যাকাউন্ট তৈরি করুন বা একটি অ্যাকাউন্ট তৈরি সম্পূর্ণ করার জন্য ব্যক্তিগত তথ্য সরবরাহ করুন। আমরা যে কোনো সময় আমাদের একক এবং পরম বিবেচনার ভিত্তিতে, কোনো কারণ বা পূর্ব নোটিশ না দিয়েই ব্যবহারকারীর নাম এবং/অথবা পাসওয়ার্ড বাতিল করতে পারি এবং এর সাথে সম্পর্কিত, এর কারণে, সৃষ্ট কোনো ক্ষতির জন্য দায়ী বা দায়ী থাকব না। এই ধরনের অনুরোধ বা অবৈধতার কারণে।

আপনার ব্যবহারকারীর শনাক্তকরণ, পাসওয়ার্ড, অ্যাকাউন্টের বিবরণ এবং সম্পর্কিত ব্যক্তিগত তথ্যের গোপনীয়তা বজায় রাখার জন্য আপনি দায়ী। আপনি এই দায়িত্ব গ্রহণ করতে সম্মত হন এবং নিশ্চিত করুন যে আপনার অ্যাকাউন্ট এবং এর সম্পর্কিত বিশদ সর্বদা সুরক্ষিতভাবে রক্ষণাবেক্ষণ করা হয়েছে এবং আপনার অ্যাকাউন্টের অপব্যবহার রোধ করার জন্য সমস্ত প্রয়োজনীয় পদক্ষেপ নেওয়া হয়েছে। আপনার যদি বিশ্বাস করার কোনো কারণ থাকে যে আপনার পাসওয়ার্ড অন্য কেউ পরিচিত হয়ে গেছে, বা পাসওয়ার্ডটি অননুমোদিতভাবে ব্যবহার করা হচ্ছে বা হওয়ার সম্ভাবনা আছে, তাহলে আপনাকে অবিলম্বে আমাদের জানাতে হবে। আপনি সম্মত হন এবং স্বীকার করেন যে সাইট এবং সম্পর্কিত পরিষেবাগুলির যে কোনও ব্যবহার এবং/অথবা আপনার অ্যাকাউন্ট এবং পাসওয়ার্ড ব্যবহার করে ব্যক্তিগত তথ্য, ডেটা বা যোগাযোগগুলিতে যে কোনও অ্যাক্সেসকে হয় আপনার দ্বারা সম্পাদিত বা আপনার দ্বারা অনুমোদিত বলে মনে করা হবে। আপনি সাইটের যেকোন অ্যাক্সেস এবং/অথবা সাইট দ্বারা প্রদত্ত যেকোন পরিষেবার ব্যবহার দ্বারা আবদ্ধ হতে সম্মত হন (সেই অ্যাক্সেস বা ব্যবহার আপনার দ্বারা অনুমোদিত হোক বা না হোক)। আপনি সম্মত হন যে আমরা এনটাইটেল (কিন্তু বাধ্য নই) এর উপর কাজ করার, আপনার উপর নির্ভর করতে বা আপনাকে সম্পূর্ণরূপে দায়ী এবং দায়বদ্ধ রাখতে পারি যেন এটি আপনার দ্বারা করা হয়েছে বা প্রেরণ করা হয়েছে। আপনি আরও সম্মত হন এবং স্বীকার করেন যে আপনি আবদ্ধ থাকবেন এবং আপনার অ্যাকাউন্টের মাধ্যমে সাইটের ব্যবহার বা অ্যাক্সেস থেকে উদ্ভূত যে কোনও এবং সমস্ত ক্ষতির বিরুদ্ধে আমাদের সম্পূর্ণরূপে ক্ষতিপূরণ দিতে সম্মত হবেন।

অনুগ্রহ করে নিশ্চিত করুন যে আপনি আমাদের যে বিশদগুলি প্রদান করেন তা সর্বদা সঠিক এবং সম্পূর্ণ। আপনি অনলাইনে আপনার অ্যাকাউন্ট অ্যাক্সেস করে আপনার অ্যাকাউন্ট সম্পর্কে রিয়েল টাইমে বিশদ আপডেট করতে বাধ্য। তথ্যের টুকরোগুলির জন্য, আপনি সাইটে আপনার অ্যাকাউন্ট অ্যাক্সেস করে আপডেট করতে পারবেন না, এই পরিবর্তনগুলিতে আপনাকে সহায়তা করার জন্য আপনাকে অবশ্যই আমাদের গ্রাহক পরিষেবা যোগাযোগ চ্যানেলগুলির মাধ্যমে আমাদের জানাতে হবে। আমরা আপনাকে পূর্ব নোটিশ ছাড়াই যেকোন সময় সাইটে অ্যাক্সেস প্রত্যাখ্যান করার, অ্যাকাউন্টগুলি বন্ধ করার, অপসারণ বা সামগ্রী সম্পাদনা করার অধিকার সংরক্ষণ করি। আমরা যেকোনো সময় আমাদের একক এবং পরম বিবেচনার ভিত্তিতে অনুরোধ করতে পারি যে আপনি আপনার ব্যক্তিগত ডেটা আপডেট করুন বা অবিলম্বে কোনো কারণ বা পূর্ব নোটিশ না দিয়ে অ্যাকাউন্ট বা সম্পর্কিত বিবরণ বাতিল করুন এবং আপনার দ্বারা ক্ষতিগ্রস্ত বা সৃষ্ট কোনো ক্ষতির জন্য দায়ী বা দায়ী থাকবে না। বা এই ধরনের অনুরোধ বা অবৈধকরণের কারণে বা এর সাথে বা এর সাথে সম্পর্কিত। আপনি এতদ্বারা সময়ে সময়ে আপনার পাসওয়ার্ড পরিবর্তন করতে এবং আপনার অ্যাকাউন্টকে সুরক্ষিত রাখতে সম্মত হন এবং এছাড়াও আপনার অ্যাকাউন্ট ও পাসওয়ার্ড এর  গোপনীয়তার রক্ষার জন্য দায়ী থাকবেন এবং ব্যবহারকারীর নাম এবং/অথবা এর কোনো প্রকাশ বা ব্যবহারের জন্য (সেই ব্যবহার অনুমোদিত বা না হোক) জন্য ও  দায়ী থাকবেন।

গ. গোপনীয়তা নীতিমালা:

অনুগ্রহ করে আমাদের গোপনীয়তা চুক্তি পর্যালোচনা করুন (এখানে ক্লিক করুন ), যা সাইটে আপনার পরিদর্শনকেও নিয়ন্ত্রণ করে। গোপনীয়তা চুক্তি এবং প্রযোজ্য আইন ও প্রবিধান অনুসারে আপনার দ্বারা বা আপনার সাইটের ব্যবহার দ্বারা আমাদের দেওয়া ব্যক্তিগত তথ্য/ডেটা কঠোরভাবে গোপনীয় হিসাবে বিবেচিত হবে। আপনি যদি গোপনীয়তা চুক্তিতে উল্লেখিত পদ্ধতিতে আপনার তথ্য স্থানান্তর বা ব্যবহার করতে আপত্তি করেন তবে দয়া করে সাইটটি ব্যবহার করবেন না।

ঘ. বিষয়বস্তু, সফ্টওয়্যার, এবং বুদ্ধিবৃত্তিক সম্পত্তি:

সমস্ত সফ্টওয়্যার এবং বিষয়বস্তুর (ফটোগ্রাফিক ছবি সহ) মেধা সম্পত্তির অধিকারগুলি আপনার কাছে এই ওয়েবসাইটে বা এর মাধ্যমে অ্যাক্সেসযোগ্য করা হয়েছে ফিলবার্ট লিমিটেড বা এর লাইসেন্সদাতাদের সম্পত্তি এবং সারা বিশ্বে কপিরাইট আইন এবং আন্তর্জাতিক চুক্তি দ্বারা সুরক্ষিত। ফিলবার্ট লিমিটেড এবং এর লাইসেন্সধারীরা এই ধরনের সমস্ত অধিকার সংরক্ষণ করে। আপনি শুধুমাত্র প্রদত্ত বিষয়বস্তু সংরক্ষণ, মুদ্রণ এবং প্রদর্শনের মাধ্যমে আপনার নিজের ব্যক্তিগত উদ্দেশ্যে ব্যবহার করতে পারেন। আপনি যে কোনো বিষয়বস্তু ব্যবহার করতে পারবেন না যা আপনাকে দেওয়া হয়েছে বা যে কোনোভাবেই এই ওয়েবসাইটে প্রদর্শিত হয়, যার মধ্যে প্রকাশ করা, ম্যানিপুলেট করা, বিতরণ করা বা অন্য কোনো উপায়ে এটি পুনরুত্পাদন করা। আপনি একটি ব্যবসা বা বাণিজ্যিক উদ্যোগের সাথে একযোগে কোনো সামগ্রী ব্যবহার করার অনুমতি দেওয়া হয় না।

আমাদের প্রয়োজন যে সাইটটি অ্যাক্সেস করার মাধ্যমে, আপনি নিশ্চিত করেন যে আপনি আইনত বাধ্যতামূলক চুক্তি গঠন করতে পারেন এবং সেইজন্য আপনি নিশ্চিত করেন যে আপনার বয়স কমপক্ষে ১৮ বছর বা আপনি পিতামাতা বা আইনী অভিভাবকের তত্ত্বাবধানে সাইটটি অ্যাক্সেস করছেন। আমরা আপনাকে সাইটটি ব্যবহার করার জন্য একটি অ-হস্তান্তরযোগ্য, প্রত্যাহারযোগ্য এবং অ-একচেটিয়া লাইসেন্স প্রদান করি, এখানে বর্ণিত শর্তাবলী অনুসারে, সাইটে বিক্রি করার জন্য তালিকাভুক্ত ব্যক্তিগত আইটেম এবং পরিষেবাগুলির জন্য কেনাকাটার উদ্দেশ্যে। কোনো তৃতীয় পক্ষের পক্ষ থেকে বাণিজ্যিক ব্যবহার বা ব্যবহার নিষিদ্ধ, আমাদের দ্বারা আগে থেকে সুস্পষ্টভাবে অনুমতি দেওয়া ছাড়া। আপনি যদি একটি ব্যবসায়িক সত্তা হিসাবে নিবন্ধন করেন, আপনি প্রতিনিধিত্ব করেন যে আপনার কাছে সেই সত্তাটিকে এই ব্যবহারকারী চুক্তিতে আবদ্ধ করার ক্ষমতা রয়েছে এবং আপনি এবং ব্যবসায়িক সত্তা অনলাইন ট্রেডিং সম্পর্কিত সমস্ত প্রযোজ্য আইন মেনে চলবেন। কোনো ব্যক্তি বা ব্যবসায়িক সত্তা একবারের বেশি সাইটের সদস্য হিসেবে নিবন্ধন করতে পারবে না। এই শর্তাবলীর কোন লঙ্ঘনের ফলে আপনাকে বিজ্ঞপ্তি ছাড়াই এই অনুচ্ছেদে দেওয়া লাইসেন্স অবিলম্বে প্রত্যাহার করা হবে।

চ. আপনার আচরণ:

• প্রতারণামূলক উদ্দেশ্যে, বা একটি ফৌজদারি অপরাধ বা অন্যান্য বেআইনী কার্যকলাপের সাথে সম্পর্কিত। আপনার নয় এমন কোনো উপাদান পাঠাতে, ব্যবহার করতে বা পুনরায় ব্যবহার করতে; বা বেআইনি, আপত্তিকর (যৌনভাবে স্পষ্ট বিষয়বস্তু বা যা বর্ণবাদ, গোঁড়ামি, ঘৃণা বা শারীরিক ক্ষতির প্রচার করে এমন উপাদান সহ কিন্তু সীমাবদ্ধ নয়), প্রতারণামূলক, বিভ্রান্তিকর, অপমানজনক, অশালীন, হয়রানিমূলক, নিন্দামূলক, মানহানিকর, মানহানিকর, অশ্লীল, অশ্লীল, পেডোফিলিক বা ভয়ঙ্কর; জাতিগতভাবে আপত্তিকর, অপমানজনক বা কপিরাইট, ট্রেডমার্ক, গোপনীয়তা, গোপনীয়তা বা অন্য কোনো মালিকানা তথ্য বা অধিকার লঙ্ঘন; অথবা অন্যথায় তৃতীয় পক্ষের জন্য ক্ষতিকর; বা অর্থ পাচার বা জুয়ার সাথে সম্পর্কিত বা প্রচার করে; বা অপ্রাপ্তবয়স্কদের জন্য যে কোনো উপায়ে ক্ষতিকর; বা অন্য ব্যক্তির ছদ্মবেশ; বা মার্কিন যুক্তরাষ্ট্রের একতা, অখণ্ডতা, নিরাপত্তা বা সার্বভৌমত্ব বা বিদেশী রাষ্ট্রের সাথে বন্ধুত্বপূর্ণ সম্পর্কের জন্য হুমকি; বা আপত্তিকর বা অন্যথায় যে কোনো উপায়ে বেআইনি; বা যা সফ্টওয়্যার ভাইরাস, রাজনৈতিক প্রচারণা, বাণিজ্যিক অনুরোধ, চেইন লেটার, গণ মেইলিং বা যেকোনো “স্প্যাম” নিয়ে গঠিত বা রয়েছে।
• অবৈধ উদ্দেশ্যে সাইট ব্যবহার করা
• বিরক্তি, অসুবিধা বা অপ্রয়োজনীয় উদ্বেগ সৃষ্টি করা।
• আমাদের উদ্দেশ্য ছাড়া অন্য কোনো উদ্দেশ্যে।

ছ. যোগাযোগ:

আপনি যখন Sweezy.com ব্যবহার করেন বা ফোন বা ইমেলের মাধ্যমে আমাদের সাথে যোগাযোগ করেন, তখন আপনি আমাদের কাছ থেকে যোগাযোগ পেতে সম্মত হন। আপনি আমাদেরকে ই-মেইল, এসএমএস, ফোন কল, বা ওয়েবসাইটে নোটিশ পোস্ট করে বা যোগাযোগের অন্য কোনো পদ্ধতির মাধ্যমে আপনার সাথে যোগাযোগ করার অনুমোদন দেন। চুক্তিভিত্তিক উদ্দেশ্যে, আপনি আমাদের কাছ থেকে যোগাযোগ (লেনদেনমূলক, প্রচারমূলক, এবং/অথবা বাণিজ্যিক বার্তা সহ) পেতে সম্মতি দিচ্ছেন, আপনার ওয়েবসাইট ব্যবহার এবং/অথবা ওয়েবসাইটে দেওয়া আপনার অর্ডারের বিষয়ে। উপরন্তু, সাইটে পোস্ট করা বা ইমেলের মাধ্যমে আপনাকে পাঠানো যেকোনো প্রকাশ লিখিতভাবে করা যোগাযোগের আইনি বাধ্যবাধকতা পূরণ করে।

ওয়েবসাইটে সদস্যতা ব্যবহারকারীদের জন্য বিনামূল্যে. ওয়েবসাইট ব্রাউজিং এবং কেনার জন্য কোনো ফি চার্জ করে না। Sweezy সময়ে সময়ে তার ফি নীতি পরিবর্তন করার অধিকার সংরক্ষণ করে। বিশেষ করে, Sweezy.shop তার নিজস্ব বিবেচনার ভিত্তিতে নতুন পরিষেবাগুলি প্রবর্তন করতে পারে এবং ওয়েবসাইটে দেওয়া কিছু বা সমস্ত বিদ্যমান পরিষেবাগুলিকে সংশোধন করতে পারে৷ এই ধরনের ইভেন্টে, Sweezy প্রদত্ত নতুন পরিষেবাগুলির জন্য ফি প্রবর্তন করার বা বিদ্যমান পরিষেবাগুলির জন্য ফি সংশোধন/পরিবর্তনের অধিকার সংরক্ষণ করে, যেমনটি হতে পারে৷ ফি নীতিতে পরিবর্তনগুলি ওয়েবসাইটে পোস্ট করা হবে এবং এই ধরনের পরিবর্তনগুলি ওয়েবসাইটে পোস্ট করার সাথে সাথেই স্বয়ংক্রিয়ভাবে কার্যকর হবে৷

ঝ. ট্রেডমার্ক এবং কপিরাইট:

Sweezy, Sweezy লোগো, Sweezy লোগোর জন্য TM, এবং আমাদের সাইটে নির্দেশিত অন্যান্য চিহ্নগুলি প্রাসঙ্গিক এখতিয়ারে ট্রেডমার্ক বা নিবন্ধিত ট্রেডমার্ক৷ আমাদের গ্রাফিক্স, লোগো, পৃষ্ঠার শিরোনাম, বোতাম আইকন, স্ক্রিপ্ট এবং পরিষেবার নামগুলি হল ট্রেডমার্ক বা ট্রেড ড্রেস এবং আমাদের অন্তর্গত নয় এমন কোনও পণ্য বা পরিষেবার সাথে বা বিভ্রান্তির কারণ হতে পারে এমন কোনও উপায়ে ব্যবহার করা যাবে না গ্রাহকদের মধ্যে, বা যে কোনও উপায়ে যা আমাদের অপমান বা অসম্মান করে। এই সাইটে প্রদর্শিত সমস্ত ট্রেডমার্ক ফিলবার্ট লিমিটেডের সম্পত্তি।

Sweezy-এ থাকা উপাদান (বিষয়বস্তু, এবং অন্য কোনো বিষয়বস্তু, সফ্টওয়্যার বা পরিষেবাগুলি সহ) হল ফিলবার্ট লিমিটেড, এর সহযোগী সংস্থা, অনুমোদিত এবং/অথবা তৃতীয়-পক্ষ লাইসেন্সকারীদের সম্পত্তি৷ ফিলবার্ট লিমিটেডের লিখিত অনুমতি ছাড়া এই সাইটের কোন উপাদান অনুলিপি, পুনরুত্পাদন, পুনঃপ্রকাশ, ইনস্টল, পোস্ট, প্রেরণ, সংরক্ষণ বা বিতরণ করা যাবে না।

ড. ক্ষতিপূরণ:

আপনি Sweezy, এর পরিচালক, কর্মকর্তা, কর্মচারী, পরামর্শদাতা, এজেন্ট এবং যেকোনো তৃতীয় পক্ষের দাবি, দায়বদ্ধতা, ক্ষতি এবং/অথবা খরচ (আইনি ফি সহ, কিন্তু সীমাবদ্ধ নয়) থেকে ক্ষতিপূরণের জন্য সম্মতি দেন এই ওয়েবসাইটের আপনার ব্যবহার বা আপনার পরিষেবার শর্তাবলী লঙ্ঘনের জন্য।

ঢ. ভিন্নতা:

Sweezy যেকোন সময় এবং পূর্ব বিজ্ঞপ্তি ছাড়াই এই ওয়েবসাইটের পরিষেবা এবং/অথবা যেকোনো পৃষ্ঠা পরিবর্তন, অপসারণ বা অন্যথায় পরিবর্তন করার অধিকার সংরক্ষণ করে।

ণ. অভিযোগ:

আপনার কোন উদ্বেগ বা মন্তব্য থাকলে অনুগ্রহ করে আমাদের জানান কারণ আমরা একটি অভিযোগ ব্যবস্থাপনা পদ্ধতি বজায় রাখি যা আমরা ব্যবহার করার চেষ্টা করব যখন সমস্যাগুলি প্রথম আবির্ভূত হবে তখন সমাধান করার চেষ্টা করব৷

ত. সম্পূর্ণ চুক্তি:

আপনার এবং Sweezy (ফিলবার্ট লিমিটেড) এর মধ্যে সমস্ত পূর্ববর্তী এবং বর্তমান চুক্তিগুলি উপরে উল্লিখিত পরিষেবার শর্তাবলী দ্বারা বাতিল করা হয়েছে, যা পক্ষগুলির সম্পূর্ণ বোঝাপড়াকে নির্দেশ করে৷ পরিষেবার শর্তাবলীর যেকোন শর্তের যেকোনও মওকুফ অবশ্যই লিখিতভাবে করতে হবে এবং বৈধ হওয়ার জন্য ফিলবার্ট লিমিটেডের ব্যবসার প্রধান দ্বারা স্বাক্ষরিত হতে হবে।

থ. সমাপ্তি:

অন্য কোনো আইনি বা ন্যায়সঙ্গত প্রতিকারের পাশাপাশি, আমরা আপনাকে পূর্বে বিজ্ঞপ্তি ছাড়াই, নিয়ম  ও শর্তাবলী অবিলম্বে বাতিল করতে পারি বা শর্তাবলীর অধীনে প্রদত্ত আপনার বা সমস্ত অধিকার প্রত্যাহার করতে পারি। এই চুক্তির যেকোন সমাপ্তির পরে, আপনি অবিলম্বে সাইটের সমস্ত অ্যাক্সেস এবং ব্যবহার বন্ধ করে দেবেন এবং আমরা, অন্য কোনও আইনি বা ন্যায়সঙ্গত প্রতিকার ছাড়াও, আপনাকে জারি করা সমস্ত পাসওয়ার্ড (গুলি) এবং অ্যাকাউন্ট সনাক্তকরণ অবিলম্বে প্রত্যাহার করব এবং আপনার অ্যাক্সেস অস্বীকার করব। সম্পূর্ণ বা আংশিকভাবে এই সাইটের ব্যবহার এবং ব্যবহার। এই চুক্তির যেকোন সমাপ্তি সমাপ্তির তারিখের আগে উদ্ভূত পক্ষগুলির সংশ্লিষ্ট অধিকার এবং বাধ্যবাধকতাগুলিকে (সীমাবদ্ধতা ছাড়াই, অর্থ প্রদানের বাধ্যবাধকতা সহ) প্রভাবিত করবে না। আপনি আরও সম্মত হন যে এই ধরনের কোনো স্থগিতাদেশ বা সমাপ্তির ফলে সাইটটি আপনার বা অন্য কোনো ব্যক্তির কাছে দায়বদ্ধ থাকবে না। আপনি যদি সাইটটির সাথে অসন্তুষ্ট হন বা সাইটটি পরিচালনার ক্ষেত্রে কোনো শর্ত, আইন, নিয়ম, নীতি, নির্দেশিকা বা অনুশীলনের সাথে অসন্তুষ্ট হন তবে আপনার একমাত্র এবং একচেটিয়া প্রতিকার হল সাইটটি ব্যবহার বন্ধ করা।

৩. বিক্রয়ের শর্তাবলী (সফওয়াট এবং গ্রাহকদের মধ্যে):

ক. চুক্তি

১) আপনার অর্ডারে পণ্য(গুলি) কেনার জন্য, আপনার অর্ডারটি আমাদের কাছে একটি ক্রয় প্রস্তাব। আপনি যখন আমাদের কাছ থেকে একটি পণ্য কেনার জন্য একটি অর্ডার দেন, তখন আপনি একটি ই-মেইল এবং/অথবা আপনার মোবাইল ফোন নম্বরে আপনার অর্ডারের প্রাপ্তি নিশ্চিত করে এবং/অথবা আপনার অর্ডারের বিশদ বিবরণ সহ একটি ই-মেইল এবং/অথবা SMS পাবেন (“অর্ডার নিশ্চিতকরণ ই-মেইল এবং/অথবা SMS”)। অর্ডার কনফার্মেশন ই-মেইল এবং/অথবা এসএমএস হল একটি স্বীকৃতি যে আমরা আপনার অর্ডার পেয়েছি, কিন্তু অর্ডার করা পণ্য(গুলি) কেনার জন্য আপনার প্রস্তাবের স্বীকৃতি নিশ্চিত করে না; যখন আমরা অর্ডার কনফার্মেশন ই-মেইল এবং/অথবা এসএমএস পাঠাই তখন পণ্য বিক্রয় আইন, ১৯৩০-এর ধারা ৪(৩) অনুসারে “বিক্রয়ের চুক্তি” নামে একটি চুক্তি সমাপ্ত হয় অর্থাৎ পণ্যের সম্পত্তি হস্তান্তর ভবিষ্যতের সময়ে সংঘটিত হবে যখন পণ্য(গুলি) আপনার নির্ধারিত ঠিকানায় পৌঁছে দেওয়া হবে। আমরা শুধুমাত্র আপনার অফারটি গ্রহণ করি এবং উপরোক্ত “বিক্রয় করার চুক্তি” পণ্য(গুলি) বিক্রয়ের একটি চুক্তিতে পরিণত হয় যেটি পণ্যের বিক্রয় আইন, ১৯৩০ এর ধারা ৪(৪) অনুসারে আপনার দ্বারা আদেশ করা হয়েছে, যখন পণ্যগুলি ) আপনার নির্ধারিত ঠিকানায় পৌঁছে দেওয়া হয় এবং সেই সময়ে পণ্যের সম্পত্তি আমাদের থেকে আপনার কাছে হস্তান্তর করা হয়।

২) পণ্যগুলি আপনার কাছে পৌঁছে দেওয়ার আগে আপনি কোনও মূল্য ছাড়াই কোনও পণ্যের জন্য আপনার অর্ডার বাতিল করতে পারেন।

৩) দয়া করে মনে রাখবেন যে আমরা কেবলমাত্র এমন পরিমাণে পণ্য বিক্রি করি যা একটি গড় পরিবারের সাধারণ চাহিদার সাথে সামঞ্জস্যপূর্ণ। এটি একটি একক অর্ডারের মধ্যে অর্ডার করা পণ্যের সংখ্যা এবং একই পণ্যের জন্য বেশ কয়েকটি অর্ডার দেওয়ার ক্ষেত্রে উভয় ক্ষেত্রেই প্রযোজ্য যেখানে স্বতন্ত্র অর্ডারগুলি একটি সাধারণ পরিবারের জন্য সাধারণ একটি পরিমাণ নিয়ে গঠিত।

খ. বিক্রয়ের শর্তাবলী

একটি অর্ডার দেওয়ার মাধ্যমে, আপনি একটি পণ্য ক্রয় করার প্রস্তাব দিচ্ছেন এবং নিম্নলিখিত শর্তাবলী সাপেক্ষে। সমস্ত অর্ডার প্রাপ্যতা এবং অর্ডার মূল্য নিশ্চিতকরণ সাপেক্ষে প্রেরণের সময়গুলি প্রাপ্যতা অনুসারে পরিবর্তিত হতে পারে এবং ডাক বিলম্ব বা জোরপূর্বক ঘটনা ঘটার ফলে যেকোন বিলম্বের সাপেক্ষে যার জন্য আমরা দায়ী থাকব না।

Sweezy এর সাথে চুক্তি করতে আপনার বয়স ১৮ বছরের বেশি হতে হবে। Sweezy আপনার করা যেকোনো অনুরোধ প্রত্যাখ্যান করার অধিকার রাখে। আপনার অর্ডার গৃহীত হলে, আমরা আপনাকে ইমেল/এসএমএস দ্বারা অবহিত করব এবং আমরা আপনার সাথে চুক্তিবদ্ধ দলের পরিচয় নিশ্চিত করব। এটি সাধারণত Sweezy হবে বা কিছু ক্ষেত্রে তৃতীয় পক্ষ হতে পারে। যখন একটি তৃতীয় পক্ষের সাথে একটি চুক্তি করা হয় Sweezy এজেন্ট বা প্রিন্সিপাল হিসাবে কাজ করে না, এবং চুক্তিটি আপনার এবং সেই তৃতীয় পক্ষের মধ্যে তৈরি হয় এবং তারা আপনাকে সরবরাহ করে এমন বিক্রয়ের শর্তাবলী সাপেক্ষে হবে৷ একটি অর্ডার দেওয়ার সময়, আপনি প্রতিশ্রুতি দেন যে আপনি আমাদেরকে প্রদান করা সমস্ত বিবরণ সত্য এবং নির্ভুল, আপনি আপনার অর্ডার দেওয়ার জন্য ব্যবহৃত ক্রেডিট বা ডেবিট কার্ডের একজন অনুমোদিত ব্যবহারকারী এবং পণ্যের খরচ কভার করার জন্য পর্যাপ্ত তহবিল রয়েছে . পণ্য এবং পরিষেবার দাম ওঠানামা করতে পারে। বিজ্ঞাপিত সমস্ত দাম এই ধরনের পরিবর্তন সাপেক্ষে.

(1) মূল্য এবং প্রাপ্যতা

আপনার শপিং কার্টের আইটেমগুলি সর্বদা আইটেমের পণ্যের বিশদ পৃষ্ঠায় প্রদর্শিত সাম্প্রতিকতম মূল্য প্রতিফলিত করবে। অনুগ্রহ করে মনে রাখবেন যে এই মূল্যটি আইটেমটির জন্য দেখানো মূল্য থেকে ভিন্ন হতে পারে যখন আপনি এটিকে আপনার কার্টে প্রথম রেখেছিলেন৷ আপনার কার্টে একটি আইটেম রাখা সেই সময়ে দেখানো মূল্য সংরক্ষণ করে না। এটাও সম্ভব যে কোনো আইটেমের দাম আপনি আপনার ঝুড়িতে রাখার সময় এবং কেনার সময়ের মধ্যে কমে যেতে পারে।

যদিও আমরা নিশ্চিত করার চেষ্টা করি যে এই ওয়েবসাইটে প্রদর্শিত সমস্ত বিবরণ, বিবরণ এবং মূল্য সঠিক, ত্রুটি ঘটতে পারে। আপনি অর্ডার করেছেন এমন কোনো পণ্যের মূল্যে যদি আমরা ত্রুটি খুঁজে পাই, তাহলে আমরা যত তাড়াতাড়ি সম্ভব আপনাকে এটি সম্পর্কে অবহিত করব এবং আপনাকে সঠিক মূল্যে আপনার অর্ডার পুনরায় নিশ্চিত করার বা এটি বাতিল করার বিকল্প দেব। আমরা যদি আপনার সাথে যোগাযোগ করতে না পারি, তাহলে আমরা অর্ডারটিকে বাতিল বলে গণ্য করব। আপনি যদি বাতিল করেন এবং আপনি ইতিমধ্যেই পণ্যের জন্য অর্থ প্রদান করেন তবে আপনি সম্পূর্ণ অর্থ ফেরত পাবেন।

ডেলিভারি খরচ ছাড়াও চার্জ করা হবে; এই ধরনের অতিরিক্ত চার্জ যেখানে প্রযোজ্য সেখানে স্পষ্টভাবে প্রদর্শিত হয় এবং ‘মোট খরচ’-এর মধ্যে অন্তর্ভুক্ত করা হয়।

আমরা প্রতিটি পণ্য তথ্য পৃষ্ঠা সহ সাইটে তালিকাভুক্ত পণ্যগুলির জন্য উপলব্ধতার তথ্য তালিকাভুক্ত করি। আমরা সেই পৃষ্ঠায় বা অন্যথায় সাইটে যা বলি তার বাইরে, আমরা প্রাপ্যতা সম্পর্কে আরও নির্দিষ্ট হতে পারি না। অনুগ্রহ করে মনে রাখবেন যে প্রেরণের অনুমানগুলি ঠিক তা। এগুলি প্রেরণের সময় গ্যারান্টিযুক্ত নয় এবং এর উপর নির্ভর করা উচিত নয়। আমরা আপনার অর্ডার প্রক্রিয়া করার সাথে সাথে, আপনার অর্ডার করা কোনো পণ্য অনুপলব্ধ হলে আপনাকে ই-মেইল বা SMS এর মাধ্যমে জানানো হবে।

(2) অর্থপ্রদান

আপনার অর্ডার পাওয়ার পর, লেনদেনটি পূরণ করার জন্য পর্যাপ্ত তহবিল আছে তা নিশ্চিত করতে আমরা আপনার পেমেন্ট কার্ডে একটি স্ট্যান্ডার্ড অনুমোদন চেক করি। অনুমোদন পাওয়ার পর আপনার কার্ড ডেবিট করা হবে। আপনার কার্ড ডেবিট করার পরে প্রাপ্ত অর্থগুলি আপনি যে পণ্যগুলি কিনতে চান তার মূল্যের বিপরীতে একটি আমানত হিসাবে বিবেচিত হবে৷ একবার পণ্যগুলি পাঠানো হয়ে গেলে এবং আপনাকে একটি নিশ্চিতকরণ ইমেল পাঠানো হলে আমানত হিসাবে প্রদত্ত অর্থগুলি নিশ্চিতকরণ ইমেলে তালিকাভুক্ত হিসাবে আপনি যে পণ্যগুলি কিনেছেন তার মূল্য বিবেচনায় ব্যবহার করা হবে।

ঙ. পণ্য পুনঃবিক্রয়:

আমাদের কাছ থেকে অনুমোদন ছাড়া ব্যবসায়িক উদ্দেশ্যে Sweezy পণ্য পুনরায় বিক্রি করা কঠোরভাবে নিষিদ্ধ। যদি কোন অননুমোদিত ব্যক্তি উপরোক্ত কাজটি করে থাকে তবে তার বিরুদ্ধে আইনগত ব্যবস্থা নেওয়া হতে পারে। Sweezy পণ্য পুনরায় বিক্রি করতে এখানে ক্লিক করুন.

চ. ট্যাক্স:

আপনি সাইট থেকে পণ্য ক্রয়ের সাথে সম্পর্কিত সমস্ত ফি/খরচ/চার্জ প্রদানের জন্য দায়ী থাকবেন এবং আপনি প্রচলিত আইন অনুযায়ী যে কোনো এবং সমস্ত প্রযোজ্য কর বহন করতে সম্মত হন।

ছ. অন্যান্য:

১) মজুদ প্রাপ্যতা:

২) ডেলিভারি টাইমলাইন:

ক) Sweezy বর্তমানে ২৪ ঘন্টা সময়সীমার মধ্যে বিতরণ করছে। যদি ব্যবহারকারী একটি সুবিধাজনক সময় নির্দিষ্ট করে, এবং আমরা সেই সময়ের মধ্যে পণ্যগুলি পাঠানোর চেষ্টা করব।

খ) সমস্ত ডেলিভারি সকাল ৯.০০ টা থেকে সন্ধ্যা ৭.০০ এর মধ্যে করা হবে (বাংলাদেশ সময়) গ্রাহকের অসুবিধা এড়াতে।

গ) Sweezy.shop দ্বারা ডেলিভারি স্বাভাবিক সময় ফ্রেম/লাইনের চেয়ে বেশি সময় লাগতে পারে। ডেলিভারি বিলম্বিত হতে পারে যার মধ্যে রাজনৈতিক অস্থিরতা, রাজনৈতিক ইভেন্ট, জাতীয়/পাবলিক ছুটির দিন, ইত্যাদি অন্তর্ভুক্ত রয়েছে তবে এতে সীমাবদ্ধ নয়।

৩)বাতিলকরণ:

Sweezy তার নিজস্ব বিবেচনার ভিত্তিতে যেকোনও অর্ডার বাতিল করার অযোগ্য অধিকার রাখে প্রেরন করার আগে এবং যে কোন কারণে পণ্যের মূল্য ভুল, স্টক নেই, মেয়াদোত্তীর্ণ, ত্রুটিপূর্ণ, ত্রুটিপূর্ণ, এবং ভুল তথ্য অন্তর্ভুক্ত থাকতে পারে কিন্তু এতেই সীমাবদ্ধ নয়। কারিগরি বা টাইপোগ্রাফিক ত্রুটি বা অন্য কোনো কারণে উদ্ভূত বিবরণ।

৪) মূল্য ফেরত সময়সীমা :

যদি কোনো অর্ডার বাতিল করা হয়, এই ধরনের আদেশের বিপরীতে অর্থপ্রদান ৭ থেকে ১০ কার্যদিবসের মধ্যে ফেরত দেওয়া হবে, তবে ব্যতিক্রমী ক্ষেত্রে এটি আরও বেশি সময় নিতে পারে। প্রদান করা হয় যে প্রাপ্ত নগদ ফেরত পরিমাণ, যদি থাকে, ফেরত পরিমাণের সাথে সমন্বয় করা হবে।

৫) গুণমান:

Delivery Timeline:

a) Sweezy is currently delivering within a 24-hour timeframe. if the user specifies a convenient time, we will try to send the products during that time.

b) All deliveries shall be made between 9:00 a.m. and 7:00 p.m. (Bangladesh time) to avoid the customer’s inconvenience.

The delivery might take longer than the usual time frame/line to be followed by Sweezy. Delivery might be delayed due to force Majuro event which includes, but is not limited to, political unrest, political event, national/public holidays, etc

Cancellation:

Sweezy retains the unqualified right to cancel any order at its sole discretion prior to dispatch and for any reason which may include, but is not limited to, the product being mispriced, out of stock, expired, defective, malfunctioned, and containing incorrect information or description arising out of technical or typographical error or for any other reason.

Refund Timeline:

If any order is canceled, the payment against such order shall be refunded within 7 to 10 working days, but it may take longer time in exceptional cases. Provided that the received cashback amount, if any, will be adjusted with the refund amount.
